|NewsletterBroadcom has accused Qualcomm of patent misuse and double recovery of royalties in its latest legal complaint in its long-running battle with mobile phone chip company.
Broadcom is seeking a legal judgment that “the sales and licensing practices of Qualcomm amount to patent misuse”.
The assertion by Broadcom is that Qualcomm's use of "exhausted" patents to control post-sale use of products in the wireless communications industry “results in a double recovery of royalties”.
Broadcom stated in its filing that it believes these practices have brought Qualcomm “a financial windfall and brought harm to the industry and consumers”.
The complaint was filed in the United States District Court for the Southern District of California in San Diego.
Qualcomm has yet to comment on this latest Broadcom filing.
In August, Nokia and Qualcomm resolved their chip royalty dispute, with Nokia making an undisclosed up-front royalty payment to Qualcomm.
