Free legislative update - with lunch!

As we say up North "you don't get owt for nowt".

Well, now you do!

On 10 July in Leeds, EY and the EKTN have put on a free update covering environmental legislation.

Only keeping you away from the office for half a day the guest speakers Mark Shayler, Leigh Holloway and myself will cover REACH, Batteries, RoHS2, WEEE, EuP, energy management and design efficiency.

Delegates will have plenty of time to question the panel and finish their morning off with one of EY's excellent buffet lunches.

Europartners Distribution Conference 2009

Just a quick plug for one of the highlights of the conference season.

The Europartners Distribution Conference takes place in Paris on the 6 and 7 of October.

The theme is the "electronic components industry after the crisis".

Guest speakers include NXP, TTI, Farnell, Avnet, Omron, AVX, FBDi and many more.

I was lucky enough to present at this conference a few years ago and I found it to be an excellent event and a great opportunity for networking.

REACH - obligations and "nice to have"

REACH data collection continues to cause chaos within the supply chain.

There are two basic "legal" obligations and no end of "nice to have's".

We are told that we should know our customers and provide specific information to match their needs, and that we should place leaflets in each parcel to be read by the user.

In an industry that ships tens of thousands of packages every single day to thousands of customers, that is simply not going to happen.

We are asked for pre-registration information and certificates of conformity......why!?

RoHS or RoHS2?

I have had a nice e-mail from a gentleman in Israel asking where the term "RoHS2" came from?

I think I am guilty here as I have used the terminology in many articles to differentiate the proposals that are under review from the original directive.

This is not an official term and once the proposals are adopted they will simply form part of the updated RoHS Directive and not RoHS2.

New BIS guidance for RoHS

The UK government has issued new guidance for those placing electrical and electronic equipment on the UK market and the application of the RoHS regulations.

The guidance covers subjects such as scope, exemptions, definitions, maximum concentration values, compliance, enforcement and penalties.

Non-compliant evaluation tools

Seems to be a bit of a fuss in mainland Europe at present in respect of semiconductor development tools, their RoHS status, and why are some manufacturer's still supplying non-compliant parts.

Back in 2006 I can clearly remember the concerns around "semiconductor evaluation boards" often referred to as "development tools".

Were they in scope of the RoHS Directive or not?

Another random substance - PAH

Polycyclic aromatic hydrocarbons (PAH) are a family of chemicals mainly derived from oil and coal but also as by-products from burning a variety of materials. Therefore the main environmental sources are from coke production, from petrol and diesel engine exhausts, from grilling meat and burning toast. Some PAH compounds, such as Benzopyrene are carcinogens, mutagens and reproductive toxins. Very few have direct uses although naphthalene was widely used at one time as mothballs and several are used as chemical intermediates to manufacture pigments.

The only restriction today of PAH is from the Marketing and Use Directive (now Annex XVII of the REACH Regulations) which bans the use of extender oil containing any of eight specified PAH in tyres.

No decision yet on battery capacity

The EU Battery Directive requires battery manufacturers and importers to mark all portable and automotive batteries with their capacity from 26 September 2009. It was also proposing that the definition of "capacity" would be published no later than 26 March 2009.

While the French firm Bio Intelligence, commissioned by the European Commission, completed their review on time last September, as yet there has been no decision on the several options they proposed.

So clearly the September 2009 deadline will be missed and even if the proposals were published now these will need to be considered by individual member states and the UK, for example, has an obligatory stakeholder consultation period.

EuP scope to widen

According to the excellent RE4view magazine produced by ERA Technology - Cobham Technical Services (click here for further details) the European Parliament has adopted the European Commission (EC) proposal to widen the scope of the Eco-design Directive 2005/32/EC to include energy related products. Until now the Directive has been limited to Energy using Products (EuPs) defined as products that consume energy during their use phase.

However, it is clear that many products have an indirect impact on the energy in use even though they do not consume energy themselves.

The EC mentions some examples including taps, showerheads, and double glazing where improvements in design could result in major energy savings.

Legislative event of the year

The "Electrical and Electronic Equipment and the Environment" Conference hosted by ERA Technology during November 2008 was probably the best event of the year in terms of legislative matters.

The programme for the 2009 conference has now been released.

The date for the diary is 17 and 18 November and the venue the Sheraton Skyline Hotel in Heathrow.

The extensive programme includes speakers from Cobham Technical Services (formerly ERA) the ECHA, DEFRA, BIS, NMO, Oko Institut, Intel and many more.

Probably the best value for money event of its kind and one not to miss.

EuP / energy related products update

The European Parliament has adopted the European Commission's (EC) proposal to widen the scope of the Eco-design Directive 2005/32/EC to include energy related products. Until now the directive was referred to as the Energy using Products Directive (EuP) that was limited to products that consume energy during use such as boilers, computers, televisions, industrial fans and light bulbs. The scope monitored energy efficiency of a product from the mining of the raw material right through to recycling at end-of-life.

However, many products have an indirect impact on the energy in use such as water using devices, taps and showerheads for example, and double glazing windows or insulating material.

Substance restrictions - the process

The recent restriction on Dimethyl Fumarate (DMF) in imported products was clearly not by the standard procedure. The use of DMF was already banned in the EU but not as a component in imported products. In the UK it resulted in illness and was largely ignored by retailers until journalists took an interest, in particular the BBC Watchdog programme. Simultaneously, a group of individuals who were suffering brought legal action against several retailers and won. There were similar issues in other Member States. It clearly was the publicity that drew the attention of the European Parliament and the EC who very quickly introduced the ban.
